According to the Florida Department of Law Enforcement, in 2020 there were 507,498 arrests made throughout the state, leading to tens of thousands of criminal cases hitting Florida courts. Of those, 99,161 occurred in Miami-Dade County.

While no one expects to run afoul of the law, being in the wrong place at the wrong time, misidentified, having false claims made against them, and more, can all result in the unthinkable: being arrested and charged with a crime.

According to Miami based criminal defense attorney Chad Piotrowski, “It can happen to anyone, regardless of their innocence. Fact is, law enforcement and district attorneys don’t’ always get it right.”

What to Do When Arrested


1. Do What Law Enforcement Says

Pay careful attention to any instructions given by the arresting officer(s) and follow them. Common requestions may include asking for full name, identification (such as a driver’s license or state-issued ID), age, date of birth, reason for being in the area and so on. Piotrowski advises that questions asked should be answered in as few words as possible without divulging any information not expressly asked for.

2. Remain Calm and Collected

Being arrested or accused of a crime is an understandably stressful situation. It is also one where remaining calm and collected is an absolute must. Regardless of innocence, now is not the time to panic. Becoming argumentative, defensive or aggressive will only hurt the individual’s case when they have their day in court.

3. Seeking Out Experienced Legal Representation

The right legal counsel can mean the difference between a guilty conviction and a criminal record that follows them for life, and being found rightfully innocent of a crime they never committed. Every Florida resident has the right to obtain legal counsel, and it is advisable that this be done as soon as possible.

What Not to Do When Arrested

1. Never Resist Law Enforcement

Law enforcement has a job to do. Even if they are wrong, running, feeling or physically resisting can put an individual at risk of injury (or worse). Similarly, doing so can be a sign of guilt, and can lead to additional charges such as assault, resisting arrest, battery of an officer or obstruction of justice. None of which will help their situation or case in court.

2. Never Talk to Police Without an Attorney Present

Law enforcement is trained to coax information out of suspects. Piotrowski reminds Miami residents that their right to remain silent is protected under the 5th Amendment and that it should be exercised. Apart from identifying one’s self, no further information should be offered, no matter how seemingly innocent, until the accused has their attorney present.
