Düsseldorf Court found for infringement of a DryLyte, S.L., patent by a competitor

Barcelona, July 16th, 2024: GPAINNOVA, a leading innovator in the metal surface finishing industry, announces that on July 2nd, 2024, the District Court Düsseldorf (“Landgericht Düsseldorf”) found for infringement of DryLyte, S.L.’s (“DryLyte”, an affiliate of GPAINNOVA), European Patent 3 372 711 B1 (court ref. 4c O 19/23) by a competitor in Germany. The patent protects a method for smoothing and polishing metals via ion transport by means of free solid bodies and devices for application of the method.

The Infringement relates to certain competitor’s electropolishing devices and solid particles used as media in the devices.

DryLyte

Inter alia, the Court ordered DryLyte’s competitor to cease and desist from manufacturing, offering, placing on the market, using, or importing and/or possessing in Federal Republic of Germany machines and polishing media for carrying out the patented method for smoothing and polishing metals by ion transport using free solids. The Court further ordered DryLyte’s competitor to cease and desist from offering and distributing certain polishing machines and the solid particles used as media for the patented finishing process without a disclaimer referencing that such use is subject to DryLyte’s prior consent.

While the decision is not yet final as the parties may appeal the decision, the decision is preliminarily enforceable re the claims set out in the decision.
